Hakam: Jurnal Kajian Hukum Islam dan Hukum Ekonomi Islam is an international peer-reviewed journal dedicated to advancing scholarly discourse in the fields of Islamic Family Law (Ahwal Syakhshiyah) and Islamic Economic Law (Muamalah). The journal publishes high-quality original research that contributes to the theoretical development and practical application of Islamic law within contemporary legal, economic, and social contexts.

Hakam welcomes interdisciplinary and comparative studies that examine the interaction between classical Islamic jurisprudence (fikih), contemporary legal thought, national legal systems, judicial practices, public policy, and socio-economic transformation in Muslim societies. The journal accommodates doctrinal (normative), empirical, socio-legal, comparative, historical, and interdisciplinary research that offers original insights into current issues and challenges in Islamic family law and Islamic economic law at both national and international levels.

 

Scope

The scope of Hakam: Jurnal Hukum Islam dan Hukum Ekonomi Islam includes, but is not limited to, the following areas:

  1. Islamic Family Law (Ahwal Syakhshiyah); Research on marriage, divorce, reconciliation, child custody (hadhanah), maintenance (nafkah), inheritance (faraidh), wills, grants (hibah), guardianship, family waqf, marital property, marriage registration, family dispute resolution, legal protection of women and children, gender issues, family resilience, and contemporary developments in Islamic family law. 
  2. Islamic Economic Law (Muamalah); Research on Islamic commercial transactions and contracts (akad), Islamic banking and finance, Islamic financial institutions, halal industry, Islamic capital markets, Islamic insurance (takaful), Islamic fintech, digital transactions, zakat, waqf, Islamic philanthropy, Islamic cooperatives, business ethics, and contemporary issues in Islamic economic law. 
  3. Islamic Law and National Legal Systems; Studies examining the interaction between Islamic law and positive law, legislation, judicial decisions, legal reform, legal harmonization, constitutional perspectives, religious court practices, fatwas, and regulatory frameworks governing family and Islamic economic matters. 
  4. Socio-Legal Studies of Islamic Law; Empirical and sociological research investigating the implementation, enforcement, effectiveness, legal culture, legal awareness, dispute resolution, mediation, customary practices ('urf), and the social dynamics influencing the application of Islamic law in contemporary society. 
  5. Contemporary Islamic Legal Thought; Research on Ushul Fikih, Maqashid Syari'ah, Qawaid fiqhiyyah, legal maxims, ijtihad, fatwa studies, Islamic legal theory, contemporary fiqh, and the reconstruction or development of Islamic legal concepts in response to emerging legal and socio-economic issues. 
  6. Comparative Islamic Law; Comparative studies involving Islamic legal schools (madhāhib), legal systems across Muslim-majority countries, Islamic law and customary law, Islamic law and civil law, and comparative legal approaches to family law and Islamic economic law.
Hakam publishes original research employing various methodological approaches, including: Doctrinal (normative) legal research; Empirical legal research; Socio-legal research; Comparative legal studies; Case law and judicial decision analysis; Legislative and policy analysis; Historical and philosophical studies of Islamic law; Interdisciplinary research integrating law with economics, sociology, anthropology, political science, technology, and other relevant disciplines.
