SEWAGHEIAN BROTHERHOOD AS A LIVING NORM IN LAMPUNG MUSLIM FAMILY RECONCILIATION: A CONCEPTUAL ANALYSIS THROUGH MAQĀṢID AL-SHARĪ'AH

Abstract


This article reconstructs Sewagheian Brotherhood as a conceptual framework for family reconciliation in Lampung Muslim customary law through a maqāṣid al-sharī‘ah perspective. The study responds to the limited attention given to customary brotherhood in discussions of family conflict within Lampung society. It employs normative-conceptual legal research with a legal-anthropological orientation. The materials consist of Islamic legal literature, Indonesian family law, studies of Lampung customary institutions, and findings reported in previous field-based research. Maqāṣid al-sharī‘ah serves as the main analytical framework, while living law and legal pluralism are used as supporting perspectives. The analysis identifies Sewagheian values related to kinship responsibility, deliberation, dignity, accountability, and relational restoration. Previous empirical studies indicate that related customary practices operate through family involvement, customary leaders, apology, compensation, and social reintegration. However, these findings do not prove that Sewagheian is uniformly applied in marital, inheritance, or intergenerational family disputes. The article therefore proposes a conceptual, not empirical, model of Sewagheian-based family reconciliation. Its legitimacy depends on its conformity with the protection of lineage, dignity, property, personal safety, welfare, and religious values. The model must be rejected when it pressures women, silences weaker parties, conceals violence, or restricts access to formal justice. The study is limited by the absence of direct fieldwork. Future research should test the model through socio-legal studies in Pepadun and Saibatin communities, focusing on authority, gender equality, consent, procedure, legal enforceability, and outcomes.
